Atlanta Fashion Week Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Atlanta Fashion Week website at https://www.atlantafashionweek.co, our applications, registrations, ticketing pages, programs, events, communications, and related services (collectively, the "Services").

Atlanta Fashion Week ("ATLFW," "we," "us," or "our") is owned and produced by RAGTRADE ATLANTA. By accessing or using the Services, submitting an application, purchasing or accepting a ticket, registering for an event, or participating in an ATLFW program, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Additional written terms may apply to a particular ticket, application, program, partnership, competition, retail opportunity, or event. If those additional terms conflict with these Terms, the additional terms will control for that specific offering.

1. Eligibility
You must be legally capable of entering into a binding agreement to use the Services. If you use the Services on behalf of a company, brand, organization, or other entity, you represent that you are authorized to bind that entity to these Terms.
Applicants to The Next Wave must be at least 21 years old. Other ATLFW programs or events may have separate age, experience, residency, or eligibility requirements. When a program permits participation by a minor, a parent or legal guardian may be required to provide consent and complete additional documentation.

2. Acceptable Use
You agree not to:

  • use the Services for an unlawful, fraudulent, harmful, or deceptive purpose;

  • interfere with the operation or security of the Services;

  • attempt to gain unauthorized access to any account, system, or information;

  • introduce viruses, malicious code, automated scraping tools, or other disruptive technology;

  • impersonate another person or misrepresent your identity, authority, affiliation, or qualifications;

  • copy, reproduce, distribute, sell, or exploit ATLFW content except as expressly permitted;

  • submit content that infringes intellectual-property, privacy, publicity, contractual, or other rights; or

  • use ATLFW's name, marks, images, event credentials, or affiliations in a way that falsely suggests endorsement, partnership, accreditation, or official status.

We may restrict or terminate access to the Services if we reasonably believe these Terms have been violated.

3. Applications, Submissions, and Selection
ATLFW may accept applications or submissions from designers, brands, media professionals, photographers, volunteers, Next Wave candidates, models, speakers, vendors, sponsors, partners, and others.
You represent that all information you submit is accurate, current, complete, and not misleading. Submission of an application does not guarantee review, acceptance, participation, media access, placement, funding, retail representation, sales, publicity, or any other outcome. ATLFW may establish selection criteria, request additional information, conduct interviews or reviews, and accept or decline an applicant in its discretion, subject to applicable law.
Deadlines, fees, deliverables, revenue shares, commissions, inventory requirements, onboarding requirements, sales terms, and other program details may vary and will be stated in the applicable application, acceptance notice, participation agreement, or other written communication.
Unless expressly stated otherwise, application and submission fees are nonrefundable because they support administrative review and processing. ATLFW may disqualify incomplete, late, inaccurate, infringing, or noncompliant submissions.

4. Your Content and Materials
You retain ownership of original portfolios, lookbooks, photographs, videos, designs, trademarks, written materials, and other content you submit ("Your Content"). You represent that you own Your Content or have all permissions necessary to submit it and grant the rights described here.

By submitting Your Content, you grant ATLFW a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and internally share it as reasonably necessary to evaluate your submission, administer the relevant opportunity, operate the Services, maintain business records, and communicate with you.

If you are accepted for or participate in an ATLFW event, program, feature, or partnership, you also grant ATLFW permission to use your approved name, biography, brand name, logo, product imagery, collection imagery, social media handle, and participation-related materials to identify, announce, promote, document, and recap that participation across ATLFW's websites, social platforms, press materials, presentations, reports, archives, and promotional channels. Any broader commercial use may be governed by a separate written agreement.

You should not submit confidential information, trade secrets, unreleased intellectual property, or other materials requiring special handling unless ATLFW has agreed in writing to receive them confidentially. Submissions do not create a confidential, fiduciary, agency, employment, partnership, or exclusivity relationship.

5. Tickets, Registrations, Payments, and Refunds
Event availability, ticket prices, service fees, taxes, entry requirements, refund terms, and transfer rules will be disclosed at the time of registration or purchase. Transactions may be processed by third-party ticketing or payment providers and may also be subject to their terms and privacy policies.

Unless otherwise stated in writing at the point of purchase:

  • tickets and registrations are revocable licenses, not property rights;

  • admission remains subject to venue capacity, credential verification, security procedures, event rules, and these Terms;

  • processing, platform, application, and service fees may be nonrefundable; and

  • resale, duplication, counterfeiting, or unauthorized transfer of tickets or credentials is prohibited.
     

Refunds, credits, or transfers, if offered, will be governed by the policy displayed for the applicable event or communicated directly to affected registrants. ATLFW is not responsible for travel, lodging, wardrobe, shipping, production, or other expenses incurred in connection with an event, application, or program.

6. Event Changes, Postponement, and Cancellation
Schedules, venues, programming, speakers, designers, performers, retail participants, sponsors, seating, formats, and event features are subject to change. ATLFW may modify, postpone, relocate, reschedule, limit, suspend, or cancel an event or program because of safety concerns, weather, public-health conditions, venue issues, governmental requirements, force majeure, operational needs, or other circumstances.

If an event is canceled or materially rescheduled, any remedy will be the remedy announced for that event and required by applicable law. Changes to individual participants, features, schedules, or programming do not automatically entitle a ticket holder or participant to a refund.

7. Event Admission and Conduct
ATLFW and its venues may refuse admission or remove any person whose conduct is unsafe, disruptive, abusive, discriminatory, harassing, unlawful, intoxicated, threatening, or inconsistent with event rules. Prohibited items, credential requirements, bag policies, security screening, dress guidance, photography restrictions, and venue rules may vary by event.
You assume responsibility for your conduct and personal property while attending an event. ATLFW is not responsible for lost, stolen, damaged, or unattended property except where liability cannot legally be excluded.
If you need a disability-related accommodation, contact atlfw@atlantafashionweek.co as early as reasonably possible. ATLFW will review accommodation requests in good faith and provide reasonable accommodations as required by applicable law.

8. Photography, Video, and Recording at Events
ATLFW events may be photographed, filmed, livestreamed, or otherwise recorded. By entering an area where event recording is taking place, you acknowledge that your image, voice, likeness, and appearance may be captured and used by ATLFW and its authorized partners for editorial, documentary, archival, promotional, advertising, sponsorship-reporting, and other lawful purposes in any media, subject to applicable law.

Where legally required or appropriate, ATLFW may provide additional notice, designated recording areas, or separate releases. If you have a concern about being recorded or need an accommodation related to event photography, contact ATLFW before the event or speak with an event representative onsite.

Attendees may not conduct professional photography, commercial filming, livestreaming, interviews, or content production without required credentials or written permission. Personal, noncommercial photography may be limited by event, venue, designer, performer, or rights-holder rules.

9. Intellectual Property
The Services and their contents—including the ATLFW name and logos, event names, graphics, text, photographs, videos, designs, layouts, databases, and software—are owned by or licensed to ATLFW and are protected by intellectual-property laws.

ATLFW grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for their intended personal or internal business purposes. No other right or license is granted. You may not use ATLFW trademarks, branding, or copyrighted materials without prior written permission, except as allowed by law.

10. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, social platforms, ticketing systems, payment processors, retailers, venues, sponsors, and other services. ATLFW does not control and is not responsible for third-party content, availability, security, products, services, policies, or practices. Your interactions with third parties are between you and the applicable third party.

References to or participation by a third party do not necessarily constitute ATLFW's endorsement of every product, service, view, or practice associated with that party.

11. Email and SMS Communications
By providing your email address, you may receive transactional communications related to registrations, applications, purchases, programs, and events. If you separately consent to marketing emails, you may unsubscribe through the link included in those messages.

If you opt in to ATLFW SMS messages, message frequency may vary and message and data rates may apply. Consent is not a condition of purchase. You may opt out by replying STOP and request help by replying HELP or emailing atlfw@atlantafashionweek.co. Mobile carriers are not responsible for delayed or undelivered messages. ATLFW may change or discontinue an SMS program as permitted by law.

12. Privacy
Our collection and use of personal information are described in the ATLFW Privacy Policy. By using the Services, you acknowledge that you have reviewed that policy.

13. Disclaimers
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. ATLFW does not guarantee that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any information will always be complete, current, or accurate.

ATLFW does not guarantee selection, attendance, press coverage, sponsorship, sales, retail placement, funding, business growth, professional opportunities, or any specific result from an application, event, introduction, program, or partnership.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of Liability
To the fullest extent permitted by law, ATLFW, RAGTRADE ATLANTA, and their owners, officers, employees, contractors, representatives, affiliates, sponsors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, data, goodwill, or opportunities arising from or related to the Services.

To the fullest extent permitted by law, ATLFW's aggregate liability for a claim arising from the Services will not exceed the greater of the amount you paid directly to ATLFW for the specific service giving rise to the claim during the twelve months before the claim or $100. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ATLFW, RAGTRADE ATLANTA, and their owners, officers, employees, contractors, representatives, affiliates, sponsors, partners, and service providers from claims, liabilities, losses, damages, judgments, and reasonable costs arising from your violation of these Terms, unlawful conduct, misuse of the Services, or infringement of another party's rights.

16. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal action arising from these Terms or the Services must be brought in a state or federal court located in Fulton County, Georgia, and you consent to the jurisdiction of those courts.

Before filing a claim, you and ATLFW agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution. Notices to ATLFW should be sent to atlfw@atlantafashionweek.co.

17. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated date. Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms, except where additional notice or consent is required by law.

18. General Provisions
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without ATLFW's written consent. ATLFW may assign these Terms in connection with a reorganization, merger, sale, or transfer of operations.

These Terms, together with the Privacy Policy and any applicable additional written terms, constitute the entire agreement regarding the Services covered by them.
